If you cannot find a case through MyCase, it is worth calling the clerk at (765) 747-7726 to ask about the best way to locate older records in Delaware County.

Fees for Delaware County Divorce Decree Copies
Delaware County follows the standard Indiana fee schedule for court record copies. As the clerk's website states: "Indiana Code requires the Clerk to collect copy fees of $1.00 per page, plus an additional $3.00 per document for certification (IC 33-37-5-1 and IC 33-37-5-3)." This means a certified copy of a one-page document costs $4.00 total. A longer decree with multiple pages costs $1.00 per page plus the $3.00 certification fee. There is no additional fee just for searching the records.
The clerk accepts payment by cash, money order, cashier's check, and in some cases by credit or debit card. Call ahead to confirm current payment options before visiting or mailing your request. Do not mail cash. Certified copies of records "may be picked up in the Clerk's Office located at the Delaware Justice Center at 3100 S. Tillotson Ave, Muncie, Indiana 47302," per the clerk's own guidance. If you cannot pick up in person, include a self-addressed stamped envelope with your mail request.
Note: Marriage license copies in Delaware County cost the same rate: $1.00 per page plus $3.00 for certification, totaling $4.00 for a standard one-page license copy.

Indiana Divorce Laws and Delaware County Courts
Delaware County courts apply Indiana's divorce statutes. IC 31-15-2-6 requires that one spouse have lived in Indiana for six months before filing, and in Delaware County for at least three months. This means you need to be a county resident for the three-month period before filing your petition at the Delaware Justice Center. If the residency requirement is not met, the court may dismiss the case or transfer it to a county where it is met.
Under IC 31-15-2-10, Indiana mandates a 60-day waiting period after a divorce petition is filed before the court can sign the final decree. This applies to all Delaware County cases. An uncontested divorce can still take at least 60 days from start to finish because of this requirement. Courts cannot waive the waiting period, even if both parties are in complete agreement and all paperwork is in order on day one. Plan your timeline with this rule in mind.
Delaware County court records, including divorce decrees, are governed by Indiana's Access to Public Records Act under IC 5-14-3. Most records are public. Sealed records, records involving juveniles, or documents the court has ordered protected may be restricted. The court filing information page on the county website has additional details about what records are accessible and how to request them.
